Introduction
Environmental consulting is the consulting specialty that is dedicated to offering advice, training and procedures related to all environmental matters of a company or organization.
An environmental consultant works with the client in areas such as water, air and soil pollution, environmental impact assessment, environmental audit, waste management, environmental policy, ecological-territorial management, noise and vibration measurement and environmental management.
In this type of work, different types of professionals perform which include; biologists, environmental engineers, biochemists, bioengineers and geologists.
Situation in Spain
After Spain joins the EU, it will still take some time to develop new environmental laws and regulations. In this new period, Law 10/1998 on Waste[1] and Royal Legislative Decree 1/2008 of January 11,[2] will stand out, by which "companies likely to carry out a potentially polluting activity must present a 'Preliminary Situation Report', thus identifying a list of activities likely to cause damage to the soil and the criteria and standards for the declaration of contaminated soils." That is, a law that forces companies to calculate the damages that a few years later, we find the Environmental Liability Law (Law 26/2007, of October 23),[3] which “obliges agents who carry out potentially polluting activities to prevent the risk and repair it, whether it has come from culpable negligence or not, because spills and contamination can cause very serious or even irreparable damage to the marine and terrestrial environment.” . In this way, the range of action of many companies will begin to be closed or, at least, forced to account if the damage caused is greater than stipulated so that, to the extent possible, disasters like Aznalcóllar do not happen again.
With the appearance of this new legislation, companies have also emerged that offer comprehensive evaluation and calculation services of the environmental damage that a certain project can inflict on the environment, that is, they carry out the report that the aforementioned Royal Decree requires of construction entities before they can build or modify in any way a certain location. These companies are called Environmental or Environmental Consulting.
