Violations and Sanctions Law
Introduction
The basic industry law currently in force in Spain is Law 21/1992, of July 16, on Industry.
Its purpose is to establish the bases for organizing the industrial sector, as well as the coordination criteria between Public Administrations.
History
The most notable legislative precedent is the Law on the organization and defense of the industry.
Violations and sanctions
Title V of the law deals with violations and penalties.
The actions or omissions of the different responsible subjects classified and sanctioned in this Law constitute administrative infractions in the matters regulated in this Law, without prejudice to the civil, criminal or other responsibilities that may arise. Notwithstanding the foregoing, when these behaviors constitute a breach of occupational health, safety and hygiene regulations, it will be this infraction that will be subject to sanctions in accordance with the provisions of said regulations.
