An urban agreement is an agreement entered into between the competent urban administration and public or private persons or entities, whose object is urban planning action[1]​[2]​, and which must be processed in accordance with current land legislation.[3]​.

Se trata de un acuerdo de voluntades en el ámbito del Derecho urbanístico en el que de forma consensuada se realiza un contrato entre dos partes frente al ejercicio de la potestad urbanística por parte de la Administración cuyo objeto es la modificación del planeamiento o su ejecución.[1]​[2]​

En contra del convenio cuya prioridad es satisfacer las necesidades estrictamente urbanísticas, se encuentra aquel que hace prevalecer el interés patrimonial de los sujetos privados y públicos que en el intervienen.[4]​.

Urban planning agreement in Spain

In Spain, urban planning agreements will be differentiated by their content and purpose in:.

a) Urban planning agreements: those that include or may have as a consequence or result possible modifications of urban planning, either directly or because these are necessary in any case for the viability of what is stipulated.[5]​.

b) Urban planning agreements for the execution of planning: those that do not affect urban planning in any way, but are limited to determining the terms and conditions of the management and execution of planning and other instruments existing at the time of their conclusion. Under no circumstances may modification, alteration, exception or exemption from planning be derived or result from compliance with these agreements.[5]​.
