Unconsolidated Urban Land (SUNC)
Introduction
The Law of Measures on Urban Planning and Land of Castilla y León aims to regulate urban planning activity in the Community of Castilla y León.[1]
The land law of Castilla y León called the Urban Planning and Land Law is law 5/1999 of April 8, substantially modified by law 4/2008 of September 15, with which the urban planning reference of Castilla y León is this last reference law. In accordance with the constitutional provisions.[2] In the exercise of this attribution, Law 5/1999, of April 8, on Urban Planning of Castilla y León, was promulgated, with the aim of fully regulating urban planning activity in the autonomous community.[3].
Structure of the law
The law has 150 articles and 6 additional provisions. It is structured in 8 titles that establish the following developments:
Autonomous competition
But the one that has the powers in regulations and execution are the autonomous communities and in the case of Castilla y León the power is exclusive with regard to urban planning. Management and control correspond to both the Community and the municipalities.
Law 5/99 “Urban Planning Law of Castilla y León (LUCyL)” regulates both the rights and duties of the different agents involved in the entire urbanization process.
Soil Classification and Qualification
The law determines the following classifications of land: urban, developable and rural.
The previous classifications and qualifications of land are applicable with restrictions to municipalities without urban planning, in these urban land is established, which will be that which is part of the population center and is integrated into the urban grid with water supply, sanitation and electricity), and rural land which will be the rest, here the classification of developable land is ignored. Urban land is classified, in these unplanned municipalities, as consolidated and here the owners will have the right to build, with prior license and as long as they complete their status as a site and transfer to the city council the land necessary to regularize the roads.
