Territorial planning law
Introduction
The Law on Territorial Planning of Castilla y León (Law 10/1998, of December 5;[1] modified by Law 3/2010, of March 26;[2] and by Law 1/2013, of February 28[3]) is the legal framework in which territorial planning is developed within the community of Castilla y León (Spain). The purpose of the law is to establish the principles and objectives of territorial planning in the community, as well as to regulate the instruments necessary for the exercise of its competence in the matter, a triple purpose:
The Spanish Constitution[4] allows the autonomous communities to assume "powers" in matters of territorial planning. The Statute of Autonomy of Castilla y León develops this provision by affirming the exclusive competence of the Community in the matter, without prejudice to the provisions of article 149 of the Constitution.
Fundamental content of the Law
The definition of a system of territorial planning instruments "that solves the insufficiencies of urban planning plans and sectoral planning, especially with regard to the treatment of supra-municipal problems" and the difficulties in properly coordinating actions with territorial impact.
The Law is conceived from a territorial perspective, taking into account, but not interfering, economic policies (without prejudging a budgetary link), administrative (without conditioning the formalization of regions or other supra-municipal entities), and environmental policies (recognizing the substantivity of said area).
Coordination with urban planning
An essential characteristic for the functioning of the system is the link that the territorial planning instruments will establish on the plans and programs with territorial impact, and especially on urban planning. However, this link presents two cautions:
