Regulations

The Technical Code is made up of a set of regulations, each of which is called Basic Document. There are 2 types of basic documents, those dedicated to security and those dedicated to habitability:.

In addition to the Basic Documents, Royal Decree 314/2006, which regulates its entry into force, is considered part of the CTE.

Each of the Basic Documents has a section called "Scope of Application" which establishes in which cases it is mandatory and in which cases it is not. The obligation changes from one DB to another, in such a way that in certain particular constructions some DBs may be applicable while others are not.

In general, the Technical Code is always mandatory in newly constructed buildings. In the case of expansion, modification, renovation or rehabilitation works carried out on existing buildings, the obligation depends on the nature of the intervention and, where appropriate, the degree of protection that the affected buildings may have.

Its compliance is not required in those constructions of technical simplicity and little construction entity, whether temporary or permanent, that are developed on a single floor and do not affect the safety of people. Residential or public constructions must comply with the Technical Code regardless of their simplicity.

Compliance with the Technical Code does not exempt compliance with the rest of the regulations in force, such as the Spanish Structural Concrete Instruction (EHE), the Regulation of Thermal Installations in Buildings "Regulation of Thermal Installations in Buildings (Spain)") (RITE 07), the Regulation of Fire Safety in Industrial Establishments, the Electrotechnical Regulation for Low Voltage (REBT 02), the Regulation Technician for the Distribution and Use of Gaseous Fuels (RD 919/2006), the Regulations regulating Common Telecommunications Infrastructures (ICT) (RD 346/2011) and specific municipal and regional regulations.

However, the infractions and sanctions for non-compliance are not clear, as no references are made to them in it.

The continuous work of several international organizations (ECE, CIB, IRCC, etc.) related to building regulations is leading to progress in regulatory systems, while studying the appropriate approach to codes based on performance or objectives.

The European Union defines in its Regulation 305/2011 on Construction Products (RPC) the requirements related to the CE marking. Compliance with the requirements established in this Regulation is mandatory, including the need to issue a Declaration of Performance for the covered products. The RCP annulled the previous Construction Products Directive, for which a series of Interpretative Documents had been issued.
