Introduction
A real estate agent (or property broker) is a natural person who is dedicated to providing mediation, advice and management services in real estate transactions related to the purchase, sale, rental, exchange or transfer of real estate.[1][2].
Professionalization
The purchase, sale, and valuation of real estate involves specific, deep and rigorous professionalization. It is also advisable to develop certain soft skills such as communication, technology skills, or teamwork.
They can work as real estate agents:.
• - Real estate agents who meet the professional qualification requirements established by their specific regulations and by this Law.[3][4].
• - All natural or legal persons who have the required professional training and comply with the legal and regulatory conditions that are required of them.[5].
Responsibilities:.
• - Have an establishment open to the public for this purpose, unless the marketing of real estate services is carried out remotely by electronic or telematic means, in which case a physical address of the responsible agent must be proven.[6].
• - Be in possession of the professional training that is legally required of them. In the case of legal entities, the training is required of the administrators or, where appropriate, the members of the board of directors. However, in countries like the Dominican Republic, the work of a real estate agent is carried out informally.
• - Constitute and maintain a guarantee, with permanent validity, that allows them to respond for the amounts they receive in the exercise of their mediation activity until they make them available to the recipients. To determine the amount of the guarantee, it is necessary to take into account the number of establishments that each agent keeps open to the public. Regulations may establish the modalities that may be adopted and the criteria for determining the risk that said guarantee must cover. In the case of registered or associated agents, the guarantee can be established through the professional association or college to which they belong.
• - Establish and maintain a civil liability policy, with permanent validity, that allows them to respond for the exercise of mediation activity. The capital to be insured by the policy must be determined by regulation, taking into account the number of establishments that each agent keeps open to the public. The insurance policy can be individual or, in the case of registered or associated agents, the collective policy concluded by the college or professional association to which they belong.[7].
