Property Registry (Real Estate)
Introduction
In Spain, the Property Registry is a state institution dependent on the Ministry of Justice "Ministerio de Justicia (Spain)") and the General Directorate of Legal Security and Public Faith. Its purpose is the registration of ownership and other real rights over real estate, with the purpose of guaranteeing the publicity and protection of legal situations related to real estate.
The Registry provides legal security to real estate and economic traffic, guaranteeing the accuracy of the data registered in it. The Registry is public for those who have a legitimate interest in knowing the status of a specific property, which must be appreciated by the property registrar.[2].
Organization
The Property Registries of Spain depend on the Ministry of Justice "Ministerio de Justicia (Spain)"). All matters relating to them are entrusted to the General Directorate of Legal Security and Public Faith. The entire Spanish territory is divided into constituencies, called mortgage districts. Each mortgage district has a Property Registry, run by a registrar, belonging to the Body of Property, Commercial and Personal Property Registrars of Spain. All registrars in Spain are part of the College of Property and Commercial Registrars of Spain.
