Prisons and penitentiary centers (Infrastructure)
Introduction
Penitentiary regime (or life) refers to the rules that regulate prison life and that seek to achieve a good coexistence between prisoners.
There are three prison regimes in Spain, which correspond to each of the classification degrees:[1].
Closed regime
It applies to those sentenced to first degree due to their dangerousness or inability to adapt to other regimes, and to preventive prisoners in whom identical circumstances occur. In this case the control and security measures are the most restrictive.
There are two modalities within this lifestyle:
The assignment and reassignment of the First Degree and therefore the application of the closed regime, as well as the assignment of modality of life, are agreed upon by the Treatment Board and approved by the Management Center.
The permanence of the inmate in a closed regime will be for the minimum necessary time, until the reasons or circumstances that served as the basis for its application disappear or significantly decrease. Every three months at most, both the classification and the inmate's living arrangement assignment will be reviewed.
Ordinary regime
It applies to prisoners classified in second degree, to unclassified prisoners and to detainees and prisoners.
In ordinary regime establishments, the principles of security, order and discipline will have their reason for being and their limit in achieving an orderly coexistence.
The internal separation in the center, in addition to being based on the criteria of sex, age, background, physical or mental state, is adjusted to the needs of the treatment, the intervention programs and the general conditions of the Center.
Work and training are considered basic activities in the life of the Center.
The schedule and calendar of activities are set by the Board of Directors, respecting eight hours of rest daily and two for internal affairs, as well as sufficient time to attend therapeutic and cultural activities and communications with family or friends. This schedule is mandatory.
