In German companies that have a works council, the Company Incorporation Act (Article 87, Section 1, Paragraph 6) gives the works council a right of co-determination when time recording is introduced. This law establishes that the “introduction and use of technical devices intended to monitor the behavior or performance of employees” require company-union co-management. It is judged differently in case law whether the works council can, on the other hand, require the employer to introduce electronic time control[2]​ in the context of the case law of the European Court of Justice.[3]​ The same applies to the participation rights of the staff council in the public sector. This also gives rise to the reverse conclusion that the works council can demand the "working hours" data to protect employees.

According to a ruling by the Federal Labor Court,[4]​ German employees who intentionally clock in incorrectly can be dismissed without prior notice for falsification. This jurisprudence stems from fraud (§ 263 StGB) and the resulting breach of trust on the part of the employee.

In Austria, the Supreme Court ruled that the recording of working hours using biometric fingerprint scans can only be introduced in companies where it has been previously agreed.[5]​.

The new regulations, whose final approval is expected throughout 2025, go beyond analog recording and make the use of digital systems mandatory to record working hours. The use of paper or Excel templates will no longer be allowed, and records must include entry, exit and breaks, be traceable and accessible electronically for the Labor Inspection. In addition, the law reduces the weekly working day to 37.5 hours (without salary reduction), reinforces the right to digital disconnection and toughens sanctions, which can reach up to €10,000 per worker in case of non-compliance. [6]​.

When using systems for recording the entry and exit times of workers, data protection aspects must be observed, which result from the General Data Protection Regulation, the general objectives of protecting information security and ruling C-55/18 of the ECJ.[7][8]​.
