• - La encuesta de Hauser (1913) concluye que de las siete ciudades con más de 100.000 habitantes, sólo dos contaban con una red amplia y moderna de alcantarillado, aunque en ambos casos (Zaragoza y Sevilla), eran patentes las deficiencias en el suministro de agua.

• - El informe del ingeniero Francisco G. de Membrillera (1919) señalaba que no existía suministro de agua potable en una tercera parte de las ciudades, en un contexto de grandes deficiencias en la limpieza urbana y el saneamiento.

Las soluciones propuestas desde la ingeniería a los problemas sanitarios de las ciudades bajo una perspectiva racional fueron: estándares de vivienda, regulaciones higiénicas, calles pavimentadas, sistemas de suministro de agua y de evacuación de residuos financiados con dinero público, control de puntos de riesgo (hospitales, cementerios).

Así fueron surgiendo una serie de normas para hacer frente a esta problemática:.

• - Instrucción General de Sanidad (1904). Acerca de la higiene municipal: limpieza, trazado, anchura y ventilación de vías públicas, desinfección de las viviendas, suministro y evacuación de aguas y residuos, control de cementerios, mataderos,….

• - Bases generales de los Reglamentos de higiene (1910).

• - Constitución de la Comisión Sanitaria Central (1920), para atender los problemas de saneamiento y potabilidad en las poblaciones de más de 10 000 habitantes.

• - Condiciones higiénicas de las viviendas y condiciones técnico-sanitarias para el ensanche y la reforma interior de poblaciones (1923).

• - Reglamento de Sanidad Municipal (1925). Se establecieron las obligaciones de los municipios: agua potable, eliminación de excrementos, higiene de la vivienda, establecimientos industriales, política sanitaria de la alimentación, prevención de enfermedades infecciosas y epidemias, asistencia benéfica, e inspección sanitaria.

En la actualidad la Constitución de 1976 atribuye al Estado la competencia en materia de bases y coordinación general de la Sanidad (artículo 149.1.16), en tanto que, de acuerdo con el artículo 148.21, relativo a Sanidad e Higiene, y los distintos Estatutos de Autonomía, las comunidades autónomas en general han asumido la competencia exclusiva en materia de sanidad e higiene.

Autonomous Statutes

• - General Health Law 14/1986:.

The Law obliges the autonomous communities to organize health services. Specifically, they must carry out the health control of:.

1. • Environment: atmospheric pollution, water supply, wastewater sanitation, urban and industrial waste, noise, vibrations.

2. • Transport.

3. • Places of human coexistence, buildings and homes.

4. • Distribution, transportation and supply of food.

In this way, the Communities are in charge of specifying and managing health issues, that is, they legislate the basic rules and their execution. Within the Statutes we can highlight:

• - Water management according to the territories through which it flows.

• - Monitoring the health conditions of the waters.

• - Control of polluting discharges to the coast.

• - The legislative capacity of territorial, coastal and urban planning.

• - The qualification and control of the activities of the R.A.M.I.N.P. (Regulation of Nuisance, Unhealthy, Harmful and Dangerous Activities) on non-developable land.

Local legislation

City councils, in turn, can assume powers under the supervision of higher bodies by carrying out complementary activities, promoting all types of activities and providing any public services that contribute to satisfying the needs and aspirations of residents.

• - Law 7/85 on the Bases of the Local Regime (L.B.R.L) in chapter III, article 25, dictates these powers:.

1. • The municipality can promote all kinds of activities and provide any public services that contribute to satisfying the needs and aspirations of the neighborhood community.

2. • The municipality will exercise the following powers in the terms of the Legislation of the State and the autonomous communities:

1. Organization of vehicle and people traffic on urban roads.

2. Civil protection, prevention and extinguishing of fires.

3. Planning, execution, management and urban discipline: promotion of housing, parks and gardens, paving of urban public roads and conservation of rural roads and highways.

4. Environmental protection.

5. Supplies, slaughterhouses, fairs, markets and defense of users and consumers.

6. Protection of public health.

7. Water supply, public lighting, cleaning, waste collection and treatment services, sewage, wastewater treatment.

8. Tourism.

• - Article 26 determines, within these powers, the services that municipalities must provide. This determination of obligation is a function of the number of inhabitants:

1. • In all municipalities: public lighting, waste collection, cleaning of road networks, drinking water supply, sewage, access to the municipality, paving of public roads and control of food and beverages.

2. • In municipalities with a population of more than 5,000 inhabitants: the same, plus waste treatment.

3. • In municipalities with a population of more than 20,000 inhabitants: the same, plus civil protection, prevention and fire extinguishing.

4. • In municipalities with more than 50,000 inhabitants: the above plus public transport and environmental protection.

• - Regulation of annoying, unhealthy, harmful and dangerous activities regulated by Decree 2414/1961; Order of March 15, 1963 that approves a series of complementary regulations:
