Introduction
The Notarial Certification Agency (ANCERT) is an entity established by the General Council of Notaries (CGN) of Spain initially as INTI, Notarial Institute of Information Technologies, dedicated to the provision of services to more than 3,000 Spanish notaries, and to the provision of certification services necessary to guarantee the security, validity and effectiveness of the issuance and reception of communications and documents through electronic, computer and telematic techniques and means (EIT) in the relationships that occur between natural and legal persons.
Law 24/2001, of December 27, on Fiscal, Administrative and Social Order Measures, established in its twenty-sixth Additional provision, the obligation for the CGN to become a Certification Services Provider, being able to enter into the appropriate contracts for these purposes.
Likewise, Law 24/2001 imposed on notaries the obligation to have the necessary telematic systems for the issuance, transmission, communication and reception of information, as well as the obligation to have an advanced electronic signature (today called electronic signature recognized according to Law 59/2003") that meets certain requirements to obtain it.
Thus, the CGN has contracted with ANCERT the necessary technical means for it to become a Certification Services Provider in the legally current terms, thus allowing the CGN to provide notaries with a recognized electronic signature that, meeting each and every one of the legal requirements, allows those to comply with the obligation to have said technical instrument that collaborates in the performance of the notarial function, also enabling notaries to communicate and access telematics. to the Administration.
History
The first institution specialized in Certification and Electronic Signature, in which Notaries and Commercial Brokers participated (public notaries whose profession was integrated into that of notaries, in Spain, in 2000), was FESTE, the Foundation for the Study of Telecommunications Security. This Foundation, chaired by Mr. Miquel Roca and directed by Mr. Julián Inza") began providing certification services in 1998.
The Notarial Certification Agency (ANCERT), formerly the Notarial Institute for Information Technologies (INTI), was established in Spain in July 2002 by the General Council of Notaries (CGN) of Spain with the aim of putting into practice the ambitious technological modernization plan of the Spanish notarial profession. It is one hundred percent owned by the General Council of Notaries.
