The Convention identifies groups that hold oral values, although it does not point to them, in a way that underlines the immaterial nature of knowledge and culture, not rooted in a specific place or community.

The concept of Representative List presented by the Convention deserves special attention. "Representative" is a potentiality that can imply both representative of the creativity of humanity, and of the cultural heritage of the States, or of the communities that are depositaries of the traditions in question.[10]​.

Intangible cultural heritage (ICH) is slightly different from the discipline of oral history: the recording, preservation and interpretation of historical information (specifically, oral tradition, based on the personal experience and opinions of the speaker). ICH seeks to preserve cultural heritage with the people of the community by protecting the processes that allow traditions and shared knowledge to pass from one to another, while oral history seeks to gather and preserve historical information from individuals and groups.

The nomination

It is based on the fact that a heritage already declared national intangible within its country or region of origin is summoned to the list for its safeguarding.

The evaluation

Every year, the Committee meets to evaluate the nominations and decide on the inscriptions of the proposed intangible heritage cultural practices and expressions. The List of Intangible Cultural Heritage in Need of Urgent Safeguarding Measures is composed of elements of intangible cultural heritage that communities and States consider to be in need of urgent safeguarding measures, while the Representative List of the Intangible Cultural Heritage of Humanity is composed of expressions that illustrate the diversity of intangible heritage and contribute to greater awareness of its importance.

In the dossiers submitted, States Parties must demonstrate that the element proposed for inscription on the Representative List meets all of the criteria listed below:

In nomination dossiers, the applicant State Party(ies), or, in cases of extreme urgency, the applicant(s), will be required to demonstrate that the element proposed for inscription on the Urgent Safeguarding List meets all of the following criteria:

Article 18 of the 2003 Convention stipulates that the Intergovernmental Committee will periodically select, among the proposals submitted by the States Parties, programs, projects and activities for the safeguarding of intangible cultural heritage, considering those that best reflect the principles and objectives of the Convention. Once selected, the Committee will promote these initiatives as good safeguarding practice and support them for wider dissemination. It is hoped that this register of good practices can serve as a platform for the exchange of good practices, as well as serve as a source of inspiration for States, communities and all those interested in the safeguarding of intangible cultural heritage.

Among the programs, projects or activities proposed to the Commission by the States Parties, only those that meet the following criteria will be included in the list:.
