Introduction
The judicial expert or forensic expert or independent expert is a professional endowed with specialized and recognized knowledge, through his or her higher education, who provides objective information based on data or an opinion based on the same data to the courts of justice on the contentious points that are the subject of their opinion. There are three types of experts, those appointed judicially and those proposed by one or both parties (and then accepted by the judge or the prosecutor "Prosecutor (official)")) and independent experts. The first two exert the same influence on the judgment; In civil jurisdiction the burden of proof falls on the party, which is where the independent expert takes on special importance as a means of proof. The appointment of the judicial or forensic expert is carried out by lottery and the election is based on lists provided by the professional associations to the courts of each community. If, prior to the claim or complaint or process, the party wants to provide a report to support the aforementioned claim, they may contact an independent expert expert to provide their report as evidence, in a judicial or non-judicial procedure before the insurance company, or a third party. There are several alternatives for hiring an independent expert, the three main options are: Expert Cabinet specialized in each subject or Professional Associations of experts. In each of these two cases, the client must contact expert by expert to obtain a comparison of the economic proposal of the expert evidence.
Judicial and independent experts are capable of executing, applying and using all techniques and resources in a scientific manner for adequate administration of the requirements of their field of work (collection of evidence "Proof (law)"), assurance, preservation, management of the chain of custody necessary to clarify the truth, etc.).
