Community management
Introduction
A property administrator (community administrator, community manager or property manager) is a professional who is responsible for managing, at the request of the owners of rural or urban properties, or by decision of a meeting of owners, the financial, legal and technical matters necessary for the maintenance and economic management of them.
This profession is free to exercise throughout Spain, although there are groups (Colleges and Associations) that try to regulate the service provided to citizens, providing their members with different tools and benefits for the exercise of their activity.[1].
History and evolution (Spain)
It arose with the publication of the Royal Decree of July 24, 1889[2] by which the Civil Code is published. In its article 392 and following, the concept of Community of Property is developed, as well as its administration and conservation.
After the Civil War, some small modifications were introduced with the Law of October 26, 1939,[3] and the so-called “horizontal property” was coined for the first time. But it was not until Law 49/1960, of July 21,[4] where the Horizontal Property Law was developed.
With Decree 693/1968, of April 1,[5] by which the National Union College of Property Administrators was created, an attempt was made to regulate the profession.
Royal Decree 1665/1991, of October 25,[6] which regulated the general system of recognition of Higher Education qualifications of the Member States of the European Economic Community that require a minimum training of three years' duration. I was beginning to realize that it was not a regulated profession as it did not have recognized studies.
The Ministerial Order of May 19, 1995, which implements Royal Decree 1665/1991, of October 25,[7] which regulates the general system of recognition of Higher Education qualifications of the Member States of the European Union that require a minimum training of three years in duration, as regards the professions of Economist, Insurance Actuary, Diploma in Business Sciences, Professor Commercial, Account Auditor and Passive Classes Qualifier. This order further clarified the previous situation.
With Law 8/1999, of April 6,[8] of Reform of Law 49/1960, of July 21, on Horizontal Property, more specifically with the new wording of art. 13.6 where it freed the exercise of the profession.
